The draft of the Opinions stipulates that if a traditional Chinese medicine practitioner practises or performs a medical treatment outside of the registered geographic area or conducts a registration outside the scope of practice, the registered Chinese medicine administrative department shall order the suspension of the practice activity for more than six months and less than one year; if the circumstances are serious, Revoke its registration certificate.
According to the Exposure Draft, the state encourages and supports social forces to organize medical institutions for Chinese medicine. The Chinese medical institutions organized by social forces and the Chinese medical institutions organized by the government enjoy the same rights in access and practice.
At the same time, the state implements classified management of TCM medical personnel. TCM medical personnel are divided into TCM physicians and traditional TCM physicians.
Among them, the qualifications and scope of practice of TCM physicians are governed by the provisions of the "Law of the People's Republic of China on the Practice of Doctors of the People's Republic of China." Traditional TCM practitioners only engage in traditional Chinese medicine services. The practice of traditional Chinese medicine practitioners should be evaluated and registered by the competent department of traditional Chinese medicine of the county-level people's government, and relevant Chinese medical treatment activities should be carried out within the scope of registration and the scope of practice.
The draft of the Opinions also stipulates that if traditional Chinese medicine clinics provide services in Chinese medicine beyond the scope, the competent department of traditional Chinese medicine in the local people's government at the county level shall order it to correct and confiscate the illegal income; if the circumstances are serious, it shall be ordered to stop practicing.
Where a person is ordered to stop practicing, the principal person in charge and the directly responsible person in charge shall not engage in the management of medical institutions within five years from the date of the decision.
Where a medical institution employs personnel who are not allowed to engage in the management of a medical institution to perform management work, the original license-issuing department shall revoke the license or the original practice filing department shall order it to cease its practice.
In addition, the draft of the Opinions stipulates that the State shall develop TCM culture and incorporate TCM culture into the national cultural development plan. Every October 11th is "Chinese Medicine Day."
